The Hive Studios LLC - Terms of Service
Welcome to The Hive Studios LLC ("The Hive Studios," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of The Hive Studios’ facilities, services, and membership program ("Services").
By signing up for a membership or using our Services, you agree to be bound by these Terms.
Membership Eligibility
To qualify for membership, you must:

Be at least 18 or have a parent/guardian present during sign up.

Provide accurate and complete information during the sign-up process.

Agree to these Terms and any policies referenced herein.
Waiting List:
Due to limited space, if a member would like to sign up but there is no room available then their information will be added to our waiting list and all members will have the option to sign up in the order they entered.
Membership Packages and Hours
Membership Options: We offer three membership packages tailored to different needs, each with 3 hourly bundles

Artist Access Package – 8, 12, & 16

Artist Plus Package – 8, 12, & 16

Independent Creator Package – 16, 24, & 32

Exclusive to Independent Engineers and Producers or at the discretion of management

Full Time and Part Time packages are available upon request and approval by management

Details of membership hours and pricing can be found on our website or provided during sign-up.
Booking Sessions:
-
Members may book sessions of any length, with a minimum duration of 1 hour and a maximum of 12 hours per day, provided they stay within the limits of their membership.

Unused membership hours do not carry over to the next month unless approved in writing by management.
-
When collaborating with other members, session hours are evenly shared, and any progress to the body of work created must be scheduled as a collaboration session lasting at least one hour and agreed upon by all members involved.

Studio sessions must be booked in advance using our scheduling system.

Session availability is subject to studio capacity and operational hours.
Hourly Usage
-
Members may request that their engineer perform the following tasks without the need for additional compensation
-
Recording, Mixing, and Mastering on the premises.
-

Members can request their engineers to work on projects without their presence. The scheduled time will still be booked and deducted from their membership hours as usual
-
Members will be given proper notice of any such sessions booked by their engineer
Session Cancellation and Rescheduling:
-
Members can cancel or reschedule sessions up to 4 hours before the start time without penalty.
-
Canceling or rescheduling within 4 hours will result in a 2-hour deduction, at management’s discretion
-
If a session isn’t canceled or rescheduled on time, the full session hours will be deducted.
-
For Artist memberships, the in-house engineer can perform work such as Editing, Mixing, or Mastering during this time so that it is not wasted.
-
Additional Hours:
Members may purchase additional studio time if they need more hours for that month.
Additional “Excess” Hours are priced as follows:

Artist Access Packages: $40.00/hour or $319.99 for 8 hours
-
Artist Plus Packages: $60.00/hour or $479.99 for 8 hours
-
Independent Creator Packages: $25.00/hour or $199.99 for 8 hours
All excess hours can be paid for on the tablet inside of the studio space.
Authorized Usage
Authorized Personnel:
-
The person whose name is on the Membership as the Primary Member has full access to the studio and all services and benefits according to the membership they sign up for.
Additional Users
-
The primary member may authorize additional individuals to use their hours without the primary member being present.
-
Authorized users must be designated in writing and can only be changed twice per calendar year and confirmed with the responsible party.
Session Guest Pass = $100/guest
-
Session Passes are required for any individual attending a session who wishes to utilize the studio and its services, unless they are already using a guest pass or are an additional authorized user.
-
Each member is granted a number of Session Guest Passes per month according to their membership.

Artist Access – 1 pass/month
-
Artis Plus – 2 passes/month
-
Independent Creators – 5 Passes/session
Session Passes can be purchased from the tablet inside of the studio space.
If an unauthorized person arrives for a session and the member is not present, the unauthorized person will be asked to wait in the common areas until the member has arrived. It is up to the engineer’s discretion if they would like to have them wait in the common areas or in the studio with them.
Payment Terms:
Billing and Payment:

Membership fees are billed monthly or biweekly and must be paid through our automated system on our website.
-
A valid debit or credit card must be used to begin and maintain your membership.
-
All payments are final and non-refundable, including for unused hours or early termination.
Members opting for bi-weekly payments must fulfill one of the following:
-
Pay the bi-weekly amount and begin their membership two weeks later; or
-
Pay the first and last bi-weekly payments upfront to begin their membership immediately.
Late Payments/Cancellation:
-
Members will have a 7-day grace period. During this time, the automated system will continue to attempt charging the card daily until payment is successful or the grace period ends.
-
Failure to make payment within the 7-day grace period will result in automatic cancellation of your membership.
Reactivation Fee:
-
Cancelled memberships will have to pay a $100 reactivation fee upon reactivating/signing up for a membership
-
Paused memberships will have the $100 reactivation fee waived upon rejoining.
Membership Changes:
-
Membership upgrades or downgrades will take effect during the next billing cycle.
-
To change your membership, first you must cancel your current membership and then use a Promo Code, given by management, during check out to sign up for the changed package.
Membership Pause Policy: $25/month
Members have the option to “Pause” their membership. Paused members will have the monthly access to the studio withdrawn.
During this time the member will receive the following

$70/hour in studio time ($10 off/hours)

Access to Member Events and Outings
Priority on Membership Openings:
-
Due to limited space, paused members will have first choice to continue their membership once a spot becomes available.

If a paused member wishes to sign up and no spot is available, they will be placed at the top of the waiting list for the next available membership slot.
Intellectual Property:
-
Members retain full rights and ownership of all bodies of work created during their sessions at The Hive Studios. The Hive Studios LLC does not claim any ownership of recordings, compositions, or other creative outputs produced within its facilities unless otherwise agreed upon in writing.

For applicable services, including but not limited to recording, mixing, and mastering, The Hive Studios and its engineers must receive credit appropriately in any public releases of the work they had a role in. Credit details will be provided by the studio upon request to ensure proper acknowledgment.

Engineers working on projects at The Hive Studios may request rights and royalties for any applicable work they believe they have contributed to creatively or technically. Work can include but is not limited to

Composing – Creating Melodic and Song Structures

Any such arrangements regarding rights and royalties must be negotiated and agreed upon in writing between the member and the engineer before the work is released.

The member is solely responsible for ensuring that their creative work does not infringe on the intellectual property rights of third parties. The Hive Studios is not liable for any copyright violations or disputes arising from the use of its services or facilities.
Code of Conduct:
Members are expected to:
-
Treat staff, equipment, and facilities with respect.
-
Adhere to all posted studio rules and instructions from staff.
-
Refrain from any unlawful or disruptive behavior.
Damage and Liability:
-
Members are responsible for any damage caused to studio equipment or facilities during their sessions.
-
The Hive Studios is not responsible for lost, stolen, or damaged personal property.
Termination and Suspension
Termination by Member:
You may cancel your membership at any time, but no refunds will be issued for any unused portion of your membership.
Termination by The Hive Studios:
We reserve the right to terminate or suspend your membership for violations of these Terms or any other policies.

In cases of termination, any unused hours will be forfeited.
Upon termination or cancellation, The Hive Studios will provide a 30-day download link for all of the members files. Members must download the files within 30 days’ notice.
Changes to Terms:
The Hive Studios reserves the right to update these Terms at any time. Changes will become effective immediately upon posting. Continued use of the Services after changes constitutes acceptance of the updated Terms.
Limitation of Liability:
To the maximum extent permitted by law, The Hive Studios shall not be liable for any direct, indirect, incidental, special, or consequential damages including, but not limited to damages or losses (financial or otherwise) that might occur as a result of as a result of:

Your Membership: Issues related to signing up, managing, or canceling your membership.

Using Their Services: Problems encountered during your use of the studio's facilities, equipment, or other services they provide.
Governing Law:
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.
