The Hive Studios LLC - Terms of Service

Welcome to The Hive Studios LLC. These Terms of Service (“Terms”) govern your access to and use of our studio, equipment, and services, as well as your membership at The Hive. By purchasing a membership or using our facilities, you agree to abide by these Terms. Please read them carefully.

Memberships

​

• Membership Types: We offer tiered membership packages, including 8-hour, 12-hour, and 16-hour

memberships, each granting different levels of studio access.

• 8-Hour Package: Members can book for up to 8 hours per month, with bookings allowed within 2 weeks

of the current date.

• 12-Hour Package: Members can book up to 12 hours per month, with bookings allowed up to 1 month in

advance.

• 16-Hour Package: Members can book freely and set up recurring appointments.

• Billing: Memberships are billed monthly on the same date each month. All membership fees are non-

refundable once billed.

• Rollover: Unused hours within a month do not roll over to the following month. Unless said otherwise by

upper management through email notification.

• Upgrades/Downgrades: Members have the right to upgrade or downgrade their membership at any time.

The change will take effect at the start of the next monthly cycle.

• Cancellations: Memberships may be canceled at any time, but you will retain access to your hours until the

end of your current billing cycle. All membership payments are non-refundable.

Booking and Usage

​

• Scheduling: Members will coordinate with their assigned engineer, if applicable, to decide the best time to

book sessions. All sessions must be booked on a shared calendar for the members to use the studio.

• Cancellations/No Shows:

     o Sessions must be canceled at least 24 hours in advance. Late cancellations or no-shows will result

in the forfeiture of booked hours.

     o Cancellations within 2 hours of the session’s start time will result in a deduction of 2 hours from

the member’s monthly total.

• Overtime: If a session exceeds the allotted time, the member will be billed for the additional time at the

standard hourly rate, provided the schedule allows for extra time.

• Late Arrivals: Studio time starts at the booked time, not the arrival time. Members are responsible for

being prompt. Late arrivals will still end at the scheduled time, and no refunds or extensions will be

granted.

Mixing Sessions

​

• Mixing Schedule: Once a member declares their song(s) ready for mixing, it is up to the engineer’s

discretion to book mixing sessions at the earliest convenience. This will expedite song delivery and free up

calendar space during prime recording hours.

• Mixing Hours: The number of hours required for mixing sessions can be determined by mutual agreement

between the member and the engineer.

• Remote Listening: If the member cannot be present during the mixing session, a broadcast link can be

provided to allow the member to listen remotely.

 

Session Cancellations

​

• Cancellation Notice: Cancellations must be made at least 3 to 4 hours before the session’s start time.

• Late Cancellation: If a session is canceled within 2 hours of the start time, 2 hours will be deducted from

the member’s monthly total.

Payment Terms

​

• Fees and Charges: Membership fees are due monthly. Any additional charges (e.g., overtime, equipment

damage) will be billed at the time of occurrence.

• Non-Payment: Failure to make timely payments may result in the suspension or termination of

membership. Members are responsible for maintaining up-to-date payment information.

• Late Fees: A 10% late fee will be applied if payment is not received within 7 days of the due date. To avoid

potential late fees, consider enrolling in our auto payment system.

• Payment Date Changes: Requests to change the payment due date must be made at least 1 month in

advance. Changes will take effect in the next billing cycle.

• Membership Cancellation: If payment is not received within 14 days of the payment due date and there is

no communication with The Hive, membership will be canceled and access to the studio revoked. The

member still has the right to request all audio files and sessions that have been had until the cancellation

date.

• Reactivation: A $100 reactivation fee will apply to any canceled membership that is later reinstated, in

addition to the regular membership payment.

• Payments are non-refundable: All membership payments are final and non-refundable. Canceling your

membership does not result in a refund of your payment for that month.

Pause Your Membership

​

• Membership Pause: Members can pause their membership for $25/month if they need to step away for

any reason. During this time, studio bookings are available at $70/hour.

• Reactivation: When resuming an active membership after a pause, no reactivation fee will be charged.

Facility Usage

​

• Respect for Equipment: Members are expected to treat all equipment and facilities with care. Any damage

caused by negligence or misuse will be billed to the responsible member.

• Cleanliness: Members are required to leave the studio in the same condition in which they found it. Failure

to clean up may result in additional cleaning fees.

• Food and Drink: Food and beverages are not permitted near studio equipment. Designated areas for

refreshments are provided. Spills or damage resulting from food/drink in non-designated areas may result

in fees.

• Guests: Members may bring guests to their sessions, but they are responsible for their guests’ behavior. The Hive reserves the right to limit the number of guests during sessions.

• Prohibited Activities: Illegal activities, including but not limited to drug use and copyright infringement,

are strictly prohibited. Any violation will result in immediate expulsion from the studio and potential legal

action.

Intellectual Property

​

• Ownership of Recordings: Members retain full rights to their recordings. The Hive does not claim

ownership of any recordings produced in the studio unless otherwise agreed upon in writing.

• Copyright Infringement: Members are solely responsible for ensuring that their recordings do not infringe

on any third-party copyrights. The Hive is not liable for any copyright violations arising from studio

sessions.

Right to Modify Terms

​

• Updates: The Hive Studios LLC reserves the right to update or modify these Terms of Service at any time.

Members will be notified of any significant changes, and continued use of the studio or membership after

such updates will signify agreement to the revised terms.

​

Governing Law

​

• These Terms are governed by and construed in accordance with the laws of the State of Texas. Any disputes arising under these Terms will be resolved in the courts of Harris County.
